2] Applicant is enjoying Ad-interim protection since last more than two years.

3] Applicant is seeking pre-arrest bail in Crime No.473 of 2018 registered on 28/12/2018 with Park Site Police Station, Vikhroli, Mumbai for the offence punishable under Sections 420, 406, 465, 467, 468 read with Section 34 of the Indian Penal Code. 1/2

904 ABA-1411-2019.doc 4] Allegation against the Applicant in the FIR is that the Applicant was one of the co-accused instrumental for promising room/flat to the complainant and accepted huge amount of consideration. 5] The learned APP on instructions submits that Applicant has not cooperated in the investigation. The FIR depicts that the Applicant is a recipient of the amount involved in the offence which is claimed to have been reflected in the bank statement.

6] Since there is sufficient material to infer prima facie involvement of the Applicant in the crime in question, in my opinion, no case for pre-arrest bail is made out. Application stands rejected. Consequently, interim protection stands vacated.
