The writ jurisdiction of this Court is invoked against the order dated 31/05/2016 passed by the District Deputy Registrar, Co-operative Societies, Pune City, Pune granting deemed conveyance to the Respondent No.1 Society.

The learned counsel appearing for the Petitioner Shri S C Wakankar draws this Court's attention to the notice dated 26/07/2016 issued by the Competent Authority and the District Deputy Registrar, Co-operative Societies, Pune City, Pune by which order the parties have been informed that the fresh application for deemed conveyance filed by the Respondent No.1 Society by impleading the original owners as parties to the Application would lgc

(918) wp-8754.16 be taken up for consideration on 17/10/2016 at 3.00pm. The learned counsel for the Petitioner states that the fresh application for deemed conveyance filed by the Respondent No.1 is therefore under consideration of the Competent Authority and the next date is 13/12/2016. It is the submission of the learned counsel for the Petitioner that the application for deemed conveyance is therefore pending for de-novo consideration by the Competent Authority and District Deputy Registrar, Co-operative Societies, Pune City, Pune. The learned counsel for the Petitioner therefore seeks withdrawal of the above Petition, in view of the said developments with liberty to challenge the impugned order if the occasion so arises in future. The above Petition is accordingly allowed to be withdrawn and disposed of as such with liberty as prayed for. The notice dated 26/07/2016 issued by the Competent Authority and District Deputy Registrar, Co-operative Societies, Pune City, Pune is taken on record and marked as "X" for identification.
