1) The learned senior counsel submits that during the pendency of the present application, investigation is completed and charge-sheet is filed. In view of this, the learned senior counsel, upon instructions seeks liberty to withdraw the application with further liberty to approach the Sessions Court under section 439 of the Code of Criminal Procedure, 1973. 2) Liberty as prayed for is granted in the interest of justice. Application stands disposed of. The learned Sessions Court shall decide the application on its own merits without being influenced by the withdrawal of this application as the application has not been heard on merits. 3) In view of the bail application is withdrawn, nothing survives in the intervention application.
