Learned Counsel for the petitioner on instructions, seeks leave to withdraw the aforesaid petition. She submits that after the aforesaid petition was filed, the petitioner filed an application before the Trial Court under Section 457 of the Criminal Procedure Code, for release of his vehicle and after the said application was rejected by the Trial Court, has approached the Appellate Court and that, the Appellate Court has reserved the Appeal for orders. 8. WP 3997-2021.doc since the petitioner has availed of an alternate efficacious remedy, the petition will not survive and as such, seeks leave to withdraw the same.

The petition is accordingly disposed of as withdrawn. 3.

We make it clear that we have not heard the petition, on merits and as such, all contentions of all parties are kept open. 4.
