927-ABA-1414-19
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO.1414 OF 2019 Muhamad Multhaseem Abdul Razzak .... Applicant versus The State of Maharashtra .... Respondent Mr. G. S. Jadhav I/b. Biju A. Aloor, Advocate for Applicant. Smt. A. A. Takalkar, APP for the State/Respondent. Mr. J. Y. Kadu, PSI Khadki Police Station present. CORAM : SARANG V. KOTWAL, J.
DATE : 4th JULY, 2019 P.C. :
1.
The applicant is seeking anticipatory bail in connection with C.R. No.353/2018 registered at Khadki Police Station under Section 376(2)(e), 376(2)(l), 376(2)(n), 354-A r/w. 34 of IPC. 2.
This is the second occasion on which the present applicant has preferred anticipatory bail application. On the previous occasion, he had filed Anticipatory Bail Application No.2353/2018. The order passed by this Court on 11/6/2019 specifically records that the Ld. Counsel for the applicant had not Mamta Kale
927-ABA-1414-19 pressed that application and the application was dismissed. 3.
After this, the applicant is claiming change in circumstances. Ld. Counsel for the applicant states that after this order dated 11/6/2019, the chargesheet was filed and hence there was change in circumstances. Ld. APP pointed out that the chargesheet was already filed on 3/2/2019. It is quite apparent that the statement made by the Ld. Counsel is not correct. Therefore, there cannot be any change in circumstances. Hence, this application cannot be entertained and is accordingly rejected. (SARANG V. KOTWAL, J.)
