The petitioner by way of filing of this writ petition has prayed for quashing of C. R. No. 228 of 2016 registered with Samarth Police Station, Pune for the offences punishable under Sections 395, 386, 341, 506(2) 323, 504 read with 34 of the Indian Penal Code. 2.

Learned APP has tendered across the bar a report prepared and singed by Mr. S. R. Salve, Jailer Class-1, Yerawada Central Prison, Pune. The same is taken on record and marked 'X' for identification. 3.

It is stated in the said report that after proper investigation in C.R. No. 228 of 2016 a charge-sheet has been filed in Sessions Case No. 287 of 2017.

In that view of the matter, the prayer of the petitioner for quashing the C.R. cannot be acceded to. In case, charge is not framed in Sessions Case No. 287 of 2017 till date, it may be open for the petitioner to avail appropriate remedy of discharge before concerned Court. 5.
