By this Application, the Applicant is seeking transfer of Marriage petition No.A-1021/2023 pending before the Family Court Pune to Family Court, Bandra.

It is contention of the learned counsel for the Applicant that, the Applicant stays at Mulund with her parents. The Respondent has business in Mumbai and he visit Mumbai frequently. The Applicant is finding difficult to attend the Court dates at Pune. Hence, requested to allow the Application. 3.

Though Respondent is served and sufficient chances given to the Respondent to argue the matter, but Respondent is N.S. Kamble page 1 of 2

12-MCA-229-23.doc absent. Hence, I am deciding this application on merit. 4.

The Applicant stays with her parents at Mulund. The Respondent visit Mumbai frequently for business purpose. The Respondent has filed Petition for Divorce, which is pending at Family Court, Pune. Considering the reasons mentioned in the Application as well as it is settled principle of law convenience of the wife has to be considered while transferring the Petition. 5.

In view of above, I pass following order.

ORDER

(i) The Marriage Petition No.A-1021 of 2023 pending before Family Court, Pune be transferred to Family Court, Bandra.

(iii) Both the parties to appear before the concerned Court on 15th February 2024.

(iv) The Application is allowed and disposed of.
