When this Writ Petition was placed today for admission in terms of our earlier order, it is stated that the petitioner has already opted for a seat and which was offered to him. He is, therefore, not interested in pressing this Writ Petition.

We are really surprised at this attitude and stand of the petitioner for he possibly had already decided to opt for the available seat; why then he questioned the whole process and, by raising the issue of its legality and validity, tried to convince the Court. He also brought about a situation whereby an ad-interim order was passed on the same lines as the Nagpur Bench of this Court, resulting in consideration of the petitioner's case for 1/2 WP-8749-16.doc
provisional admission. While we disapprove of such conduct of the petitioner, who was sure of his selection, we do not observe anything further.

Writ Petition is disposed of as withdrawn and not pressed. 4.
In view thereof, we do not take the affidavit filed by the respondents on record.
