Mr. Shriram S. Kulkarni for Respondent Nos.1 & 2. Mr. B.V. Samant, AGP, for Respondent No.4.

CORAM: S.C. DHARMADHIKARI & R.I. CHAGLA, JJ.

DATE : DECEMBER 19, 2019 P.C:

1.

In terms of the statements which have been made in the Court and recorded on 3-12-2019, we are informed that a Demand Draft of Rs.12,50,000/- is brought in the Court. 2.

The order passed by this Court is thus complied with, albeit belatedly.

3.

In the light of the fact that the Administrative Officer, Nashik Municipal Corporation had to hear the parties, determine the amount payable by respondent Nos.1 and 2, he has passed the order determining that amount but the same could not be complied with although a direction was issued to

suresh 914-CP-352.2012.doc comply with the same, to our mind, the delay in compliance therewith can be condoned.

4.

The order passed on 6-3-2012 disposing of the contempt petition (No.193 of 2011) previously filed, though not to be treated as a precedent, still in the facts peculiar to this case, this contempt petition stands disposed of. The order dated 4-10-2010 is complied with.

5.

This order is passed in the presence of the parties. (R.I. CHAGLA, J.) (S.C. DHARMADHIKARI, J.) by SURESH JAGDISH SAJNAWAT Date:
