By this petition under Article 227 of the Constitution of India the Petitioner challenges the order dated 27.04.2016 passed by Joint Civil Judge, Senior Division, Thane below Exhibit- 23 in Special Civil Suit No. 20 of 2016 rejecting their Application under section 9A of the Code of Civil Procedure, 1908 to frame preliminary issue regarding bar of limitation. In view of subsequent development i.e. deletion of section 9A of the Code of Civil Procedure, 1908 nothing survives in the present Writ Petition.
