This Application is preferred by the Plaintiff for return of original documents i.e. Goldsmith license at Sr.No.8 and Shop Act license at Sr.No.9 in the list of compilation of documents filed by the Applicant in the Trial Court. The learned counsel for the Applicant submits that he requires both these documents for renewal. He undertakes to furnish true photocopy of the license. He undertakes to produce the original license as soon as same is renewed. To that effect he undertakes to file an affidavit on record.

Considering the undertaking given by the Applicant, I am of the opinion that the Applicant has made out a case for allowing the Application. 4.

Hence, the following order:

a.

The Applicant is permitted to collect Goldsmith license at Sr.No.8 and Shop Act license at Sr.No.9 in the list of compilation of documents filed by the Applicant in the Trial Court which is in the record and proceeding, on condition that the Applicant will furnish a true photocopy of the license and that he will produce the original renewed license as and when same is ready.

b.

The Applicant is restrained by an order of injunction from creating any third party right, title and interest in respect of the Goldsmith license and Shop Act license, till hearing and final disposal of the present appeal.

Civil Application stands disposed off accordingly.
