When this Application was on board dated 7th March, 2024, none had appeared for the Applicant. Learned APP was directed to take instructions about the present status of the investigation and filing of the charge-sheet. 2.

Learned APP on instructions from the concerned officer who is present in the Court informs that after 9th September, 2021, Applicant was never called to the Police Station. 3.

This Court finds that since the Applicant was not even called for interrogation by the Police, his custodial interrogation is not necessary.

Though served none appears for Respondent No.2. BGP.

For all the above reasons, this Court finds that the Application can be allowed. In case Police wants to interrogate the Applicant, Police shall give notice to him at least 72 hours in advance. Hence, the following order :- i) The Application stands allowed.

ii) In case the Police wants to interrogate the Applicant, Police shall give notice of 72 hours to the Applicant. 6.
