Challenging the show cause notice dated 28th October, 2016 (Exhibit "D"), this Petition has filed. According to the Petitioner after receipt of the show cause notice, he sent various letters including the letter dated 11th November, 2016 (Exhibit "G") and the notice dated 28th December, 2016 (Exhibit "H") but till date no decision has been taken on the said reply to the show cause notice.

We find that the show cause notice issued to the Petitioner by Respondent No. 3 but the Petitioner had made Vishal Parekar 1/2
prod-519-wpst-20079-2017.doc correspondence with Respondent No. 4 instead of the third Respondent.

In the circumstances, we dispose of this Petition with liberty to the Petitioner to submit a detailed reply to the show cause notice to Respondent No. 3 within four weeks from today. 5.
On receipt of the said reply the Respondent No. 3 - Chief Engineer (NW) shall consider the Petitioner's case and shall pass a reasoned order in regard to the allegations levelled in the show cause notice.

Let the decision as aforesaid be taken within two months from the date of receipt of reply of the Petitioner to the show cause notice by Respondent No. 3.
