Heard learned Counsel for the applicant and the learned A.P.P. 2.
By this application, the applicant seeks his enlargement on bail, pending the hearing and final disposal of the aforesaid Criminal Appeal.

Learned Counsel for the applicant states that the incident in question has taken place on the spur of the moment. He submitted that in
2/3 the fight that took place a beer bottle was broken and the injured was assaulted with a beer bottle. He submitted that considering the medical evidence, no offence as alleged is disclosed as against the applicant under Section 326 of the Indian Penal Code. He further submitted that the applicant was on bail and that he has not misused the liberty granted to him. 4.
Considering the aforesaid and the fact that Appeal is admitted, the application is allowed and the applicant's sentence is suspended and the applicant is enlarged on bail on the following terms and conditions :
ORDER
(i) The applicant be enlarged on bail, on executing PR Bond in the sum of Rs. 15,000/- with one or two local sureties in the like amount; (ii) The applicant shall report the concerned Trial Court on the 1st Monday of every alternate month, pending the hearing and final disposal of the appeal;
(iii) If the 1st Monday is a holiday, then the applicant shall report on the next following day.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
