After hearing learned counsel for the petitioner for considerable length of time and when I expressed my disinclination to interfere in the order impugned being order dated 30/08/2021 passed by the Additional Sessions Judge in execution application, learned counsel Mr. Saraogi states that he will not press the petition. He also makes a statement that he has already instituted a suit in the City Civil Court at Bombay vide Suit No.2836 of 2018.
