After arguing at length, the learned Counsel for the applicant submits that since the charge-sheet is filed during the pendency of the application and seeks liberty to withdraw the application and approach the Sessions Court seeking enlargement on bail, as this Court was not inclined to consider the application after perusal of the papers of investigation. The Sessions Court may decide the application on its own merits. The application stands dismissed as withdrawn and disposed of accordingly.
