The learned APP submits that the charge is framed. The last date was on 18.1.2017.

The learned counsel for the applicant fairly submits that the learned Sessions Court was informed that the present application seeking enlargement on bail is pending and, therefore, the Court had not proceeded with the trial. The next scheduled date is 3.2.2017. In view of this, the application stands disposed of.

In fact, on 11.1.2017, this Court had made it clear that pendency of this application shall not be construed as an impediment to proceed with the trial in Sessions Case No.77 of 2016 pending before the

Mhi 2 BA-1494-16.sxw Sessions Court. Despite that the learned Sessions Court had adjourned the matter.

The learned Sessions Court is requested to make an endeavour to record the substantive evidence of the witnesses, as far as possible within six months from today. The learned Sessions Judge shall not give any unwarranted adjournment to the prosecution or to the accused. 5.
