1] Applicant was apprehended on 28/05/2021 after he has absconded from the spot of incident on 14/04/2021 in C.R. no. 218/2021 registered with Dahisar police station for Offences punishable under Sections 307 r/w 34 of the Indian Penal Code. 2] Apart from the statement of the complainant, other evidence speaks of prima facie involvement of the applicant in the crime in question.

41.3317.21 BA.doc 3] Though it is claimed that applicant has not actively participated in the crime, statement of the complainant in categorical terms attributed active role to the applicant in the commission of crime. Complainant has suffered grievous injury.

4] As such, no case for bail is made out. Application as such fails, stands rejected.

5] Liberty to approach the Court below afresh after charge is framed.
