This is an Application for expediting the hearing of the Criminal Appeal No.334 of 2014 arising out the Special Case No.107 of 2013.
Heard learned Counsel appearing for the Applicant. The learned Counsel for the Applicant submits that the Applicant was in the service of Mumbai Police. He submits that after a full-fledged trial conducted by the learned Special Judge (under Prevention of Corruption Act), Greater Mumbai, the Applicant has been convicted for an offences punishable under Sections 7, 13(1) (d) read with 13(2) of the Prevention of
Corruption Act, 1988. He submits that the Appeal has been admitted and the Applicant has been released on bail by this Court. He further submits that after the Trial Court convicting the Applicant, the Appointing Authority has terminated him from the service. He submits that the Applicant being the only earning member in the family, the present Appeal may be heard finally by fixing peremptory date as he is having an excellent case on merit. He further submits that as per his assessment the order of conviction may result into acquittal after hearing by this Court. He, therefore, urged that the Appeal may be taken up for final hearing by fixing peremptory date.
The record discloses that the Record and Proceedings along with paper-books have been received by the Registry of this Court. It is, therefore, in the interest of justice that the prayer of the Applicant can be acceded to.
The Registry is hereby directed to place the Criminal Appeal on final hearing board as per its own turn in the week commencing from 9th February 2015.
Application is allowed in the above terms.
