The learned counsel appearing for Appellant seeks leave to withdraw the appeal with liberty to press the Notice of Motion for final disposal. He submits that City Civil Court be directed to decide Notice of Motion in a time bound manner. I am not aware about the pendency of before the City Civil Court. However considering the fact that Notice of Motion is filed seeking temporary injunction, it would be open for the Appellant to request the City Civil Court to decide the same expeditiously.
