Mr. Bansode, learned Counsel for the Petitioner submits that his grievance is not about the lapsing of reservation under section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 [for short "the Act of 2013"]. He submits that since declaration was issued under the Land Acquisition Act, 1894 and the award was passed subsequent to the coming into force of the Act of 2013, the Petitioner is entitled for the compensation as per the Act of 2013.

In the light of above submissions, Mr. Bansode seeks leave to withdraw the writ petition with liberty to file fresh petition. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is dismissed as such. Nonetheless, if the Petitioner has patilsr 1 / 2

any grievance about the quantum of compensation, he is at liberty to approach the Competent Authority under section 64 of the Act of 2013.
