Heard Mr.Suresh Dubey, learned counsel for the applicant.

This is an application for deleting Petitioner and substituting applicants in his place on account of death of sole petitioner. The sole petitioner in main petition died on 19.9.2007 during pendency of the petition.

Mr.Dubey submitted that rule is issued in the main petition and during pendency of the petition, the sole petitioner expired leaving behind the applicants. He further submitted that he has served copy of the application on the

2/2 CAW/2211/2015 respondents. He has also filed affidavit of service to that effect. None appears for the respondents. No reply is filed opposing the application.

In view thereof and for the reasons stated in the Application, Civil Application is allowed in terms of prayer clauses (a), (b) with no order as to costs.

Amendment in the main petition shall be carried out within 14 days from today and amended slip shall be made over to other side.
