The petition is filed seeking quashment of FIR bearing CR No.102 of 2016 registered with Vimantal Police State, Pune, for the offences punishable under sections 120B, 148, 149, 323, 324, 326, 342, 379, 504, 506 read with section 34 of the Indian Penal Code, 1860. 2.

Mr. Saste, learned APP, on instructions, make a statement that the investigation into the subject FIR having been completed, "B" Summary report is already filed before the JMFC, Court No.5, Shivaji Nagar, Pune. In support of his statement, he has placed on record a communication dated 28th August, 2018 of the Police Sub-Inspector, Vimantal Police Station, Pune.

The learned counsel for the respondent No.2 also submitted that his client has filed a protest petition and notice is already issued to the applicants.

In the light of the above, the applicants' grievance, at this stage, no more survives. The criminal application is, accordingly, dismissed.
