In Crime No. 85/2018 registered with Malegaon Chavani Police Station, Dist. Nashik for offence punishable under Sections 420, 465, 467, 468, 471, 199 and 200 of the Indian Penal Code, applicant is seeking pre-arrest bail.

The prosecution case is inspite of the charge of the Cooperative sugar factory on the land which was purchased by the

2 26.1353.18 aba.doc complainant, applicant has issued 7/12 extract certifying absence of such charge. As a consequence, complainant came to be duped. As such, offence in question.

Applicant is a public servant. Offence in question is based on documentary evidence which are very much available in the custody of the Investigating Officer. Apart from above, there are no criminal antecedents against the applicant. Applicant is very much available for the investigation. As such, interim order passed by this Court on 11/07/2018 for the aforesaid reasons stands confirmed. Applicant shall attend the Investigating Officer on 28/01/2019, 31/01/2019 and 02/02/2019 between 10.00 a.m. to 12.00 noon and thereafter as and when directed by the Investigating Officer.

Application stands disposed of.
