Heard learned counsel for the applicants. One Suit No.3614/2007 is pending before the City Civil Court for perpetual injunction and consequential reliefs whereas other Suit is pending in Small Causes Court for determination of tenancy rights. Both the suits are between the same parties relating to each other, in both party is claiming to be tenant. The Small Causes Court has jurisdiction to conduct issue regarding tenancy which is not vested with the City Civil Court. Hence, both the matters cannot be clubbed. Application stands dismissed and is accordingly disposed of.
