Not on board. In view of urgency, taken on board. 2] The grievance of the petitioner is that his passport has not been renewed as yet by the concerned Passport Officer. According to the petitioner, he is entitled for renewal of his passport for 10 years. 3] Learned counsel appearing for respondent No.2 submits that as per the Notification dated 25th August 1993 issued by the Ministry of External Affairs, the petitioner is required to make application before the concerned Criminal Court before whom the Dinesh Sherla 1/2
2 510-wp-8270-17.sxw matters are pending for requisite permission. 4] In view of the aforesaid while disposing of this petition, we observe that in case such application is submitted by the petitioner indicating therein the provisions contained in Section 6(2)(f) of the Passports Act 1967 read with the relevant provisions of the said Notification dated 25th August 1993, the concerned Magistrates shall consider and decide the application as early as possible in accordance with law.
5] We, accordingly, grant liberty to the petitioner to file appropriate applications before the concerned Courts where cases against him are pending.
6] With aforesaid liberty, this writ petition is disposed of. In case, the petitioner gets favourable orders, we expect that the Passport Authority shall take into consideration the said orders while renewing the petitioner's application for renewal of the passport.
