Learned counsel for the applicants seeks adjournment. It is seen that following averments are made in para 6 of the body of this application which read thus: "6.

The Applicant has not filed any other Application either in this Hon'ble Court or in the Supreme Court of India, touching to the subject matter of the present Application, except the present Application."

It is seen that the present applicant has earlier moved a bail application which was numbered as Bail Application No. 2065 of 2015 after filing of the charge-sheet. By reasoned order, that application came to be rejected on 2nd December, 2015 by this court and that too on merit. Borey 1/2

spb/ 910ba1497-16.doc In this view of the matter though the learned counsel for the applicant seeks adjournment, this court is of the opinion that the present application cannot be considered, as earlier application was dismissed on merits and the said fact is suppressed by the applicant.

Hence, this application is rejected.
