This Petition is filed by the State of Maharashtra challenging the order passed by the Maharashtra Administrative Tribunal (the Tribunal), Mumbai dated 7 October 2015 allowing Original Application No. 518 of 2015 filed by the Respondent/ Original Applicant.

The Respondent/ Original Applicant had challenged the order of his transfer dated 2 July 2015. The Tribunal, for the reasons stated in the impugned order, accepted the challenge and set aside the order of transfer. The Petition was filed in the year 2016 and has

Trupti 2 22-wp-10836-2016.doc remained pending with no interim order. The Tribunal had directed that the order be implemented within a period of 30 days. 3.

None appears for the Respondent/ Original Applicant. Several developments must have taken place in last eight years. The Respondent/ Applicant could have been transferred to somewhere else. We also note that in the year 2015 when the Respondent/ Original Applicant filed the Original Application, he was 56 years old. As on today, the Respondent/ Original Applicant could have been retired on superannuation. According to us, nothing survives in the Writ Petition.
