This is the second application for bail. The earlier bail application No.86/2016 preferred by the applicant was dismissed as withdrawn with liberty to the applicant to file fresh bail application before the Trial Court if the trial pertaining to CR No.56/2015 registered with DCB CID, Unit 10 does not commence by 31.12.2016. 2.

It appears that without availing the liberty granted to the applicant by order dated 29.2.2016 the applicant has preferred this application directly before this Court. Being confronted with the said fact situation, the learned counsel for the applicant on instructions seeks leave to withdraw the present application with a view to avail the liberty granted by this Court on 29.2.2016.
