Heard learned counsel for the parties.

Taking into consideration the averments made in the civil application delay of 85 days is condoned. 3.

Civil Application is filed to bring on record the legal heirs and representatives of the deceased-respondent no.1 who expired on 27.1.2016 during the pendency of this writ petition. 4.

It is in the interest of justice and for proper adjudication of the writ petition the legal heirs of respondent no.1 be brought on

Rng 2 record.

Accordingly, civil application is allowed in terms of prayer clause (b). Learned counsel for the applicant shall furnish the names of the legal heirs of respondent no.1 to the advocate for the petitioner within one week from today. Amendment to be carried out within a period of three weeks and amended copy be served on the respondents.

Civil Application is accordingly disposed of in above terms. No order as to costs.
