Heard Mr. Kumbhar, learned counsel appearing for the Petitioners.

By the impugned order dated 4th February 2019 passed by the learned J.M.F.C., Islampur in Criminal Miscellaneous Application No.657 of 2018, interim custody of the minor daughter was granted to the Respondent i.e. mother. The said impugned order has been confirmed by the Appellate Court.

Mr. Kumbhar, learned counsel states that the Petitioners do not intend to prosecute the Writ Petition.

02-WP-3452-2019.doc Accordingly, the Writ Petition is allowed to be withdrawn and dismissed as such.

As a result of dismissal of the Writ Petition as withdrawn, the challenge to the impugned order dated 4th February 2019 passed by the learned J.M.F.C., Islampur in Criminal Miscellaneous Application No.657 of 2018 granting interim custody of the minor daughter of the Respondent i.e. mother as confirmed by the the Appellate Court fails. 5.

Accordingly, the Writ Petition is dismissed with no order as to costs.
