The Applicant is seeking anticipatory bail in connection with C.R.No.122/2020 dated 09/03/2020 registered with Baramati City Police Station, under sections 452, 354, 392, 323, 504, 506 r/w 34 of the Indian Penal Code.

Learned counsel for the Applicant submitted that there is a cross case in respect of same incident dated 09/03/2021, Nesarikar
2 / 3 which had taken place at 08.30. That FIR is registered as C.R.No.123/2020 at the same police station under sections 354, 395, 323, 504, 506 of the Indian Penal Code. That FIR is lodged by the Applicant'
s mother.

Learned APP on instructions states that the parties are closely related. Accused in the cross FIR i.e. C.R.No.123/2020 are granted anticipatory bail. She submitted that considering their close relations and considering time span which has lapsed since the date of incident, the investigating agency does not really want the Applicant'
s custody for investigating purposes. It will be sufficient if he attends the police station as and when called.

Considering these submissions, application can be allowed.

Hence, the following order :

O R D E R
(i) In the event of his arrest in connection with C.R.No.122/2020 dated 09/03/2020 registered with Baramati City Police Station, the Applicant is directed to be released on bail on his furnishing PR bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.
(ii) The Applicant shall attend the concerned Police Station as and when called and shall cooperate with the investigation.
(iii) If the Applicant does not cooperate with the investigation or does not regularly attend the Court, the State is at liberty to make an application for cancellation of this order.
(iv) Application stands disposed of accordingly. (SARANG V. KOTWAL, J.)
