Learned counsel for the Petitioners seeks leave to withdraw the writ petition with liberty to file discharge application before the trial Court. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is dismissed as such. 2.
However, insofar as prayer clause (c) is concerned, the Petitioners are at liberty to make complaint before the Commissioner of Police, Mumbai. In the event, the Petitioners approach the Commissioner with such complaint, the Commissioner shall, after holding a preliminary enquiry, take appropriate decision in accordance with law and proceed further in the matter.
