This is an application for bail in connection with C.R. No.74 of 2018, registered with Sinhagad Road Police Station, Pune, for the ofence punishable under Section 302 read with 34 of Indian Penal Code.

The previous application was disposed of vide order dated 21st December, 2018, with observations that the Court was not inclined to grant the application and hence, it was withdrawn.

rpa 2/2 39-ba-1881-19.doc However, since the co-ordinate Bench which had passed the earlier order dated 21st December, 2018, directed by subsequent order dated 13th November, 2019, not to place the matter before the bench, application is listed before this Court. It is submitted that trial has commenced and prosecution has examined two witnesses. Both witnesses have not supported the prosecution case. In this circumstances, it is submitted that the trial may be expedited. Learned counsel for the applicant submits that he would not press this application in the event trial is expedited. In view of the submission, the application is disposed of, as not pressed. The trial is expedited. Applicant is in custody from 12th February, 2018. In the circumstances, trial Court shall make an endeavour to complete the trial within six months from receipt of this order. Bail Application stands disposed of.
