By this Petition under Article 227 of the Constitution of India, the petitioner, hereinafter referred to as "plaintiff No.2" has challenged the order dated 4th May, 2018 passed by the learned Judge, Court Room No.38 of the Court of Small Causes at Mumbai (Bandra Branch) below Exhibit 196 in R.A.E & R Suit No.54/176 of 1994. By that order, the learned trial Judge kept the consent terms entered into between plaintiff and defendant No.1 and 3(a) pending till the final disposal of the suit.

After arguing the Petition for quite some time, Mr. Khan seeks permission to withdraw the Petition. In view thereof, Petition is dismissed as withdrawn. Order accordingly.
