The petitioners are before us seeking permission to start Marathi medium school on an aided basis in terms of the Government Resolution (GR) dated 7th August 2013 and therefore prayed for not only to grant the permission but also to release grantin-aid. The petitioner wants to commence a Marathi medium secondary school by name of Sarvodaya Marathi Vidyalaya in the district of Sangli with initial aid of 20% in the first phase.

Learned AGP appearing for the State brings to our notice that on 15th November 2016 this GR dated 7th August 2013 is withdrawn.

In the light of the submission made by learned AGP, we fail to understand how the petition can be proceeded further. As a matter of fact, even with GR dated 7th August 2013 in order and force, no one can claim the benefit as a matter of right. They must approach the Government and it is for the Government to consider such claim as per their policy. In that view of the matter, even if the GR was to be implemented, at the most, we could have directed the respondent authorities to consider the application of the petitioner and dispose it of in accordance with the procedure contemplated. However, now since the very GR has been withdrawn, we do not find any good ground to entertain this petition. Accordingly, the petition is disposed of.
