The applicant is seeking pre-arrest bail in Crime No.101 of 2016. Apart from unexplained delay of about 3 weeks in lodging F.I.R., I hardly see satisfaction of necessary ingredients of Section 306. In the background of what has been stated in F.I.R. attraction of section 498 is also can not be inferred in the background of the detail of calls of the deceased and present applicant.

Hence, the application is allowed. In the event of arrest, the applicant be released on bail on executing P.R. Bond of Rs.50,000/- with one or two sureties in the like amount. The applicant shall appear before the Investigating Officer as and when called. The applicant shall not tamper with the evidence or influence the witnesses. (N.W. SAMBRE, J.) Waghmare 1/1
