The applicant is apprehending arrest in the Crime No.103 of 2018 registered with Malegaon Police Station, Nashik for the offence punishable under Section 420 of the IPC. On 6.9.2018, the applicant had agreed to deposit Rs.3 lakhs within a period of two weeks. Office remark shows that money has been not been deposited. The learned advocate for the Applicant is absent.

Perused the complaint. It shows that the applicant had promised the complainant to secure job in the district Court and on Shivgan 1/2

5-ABA-1369-2018.odt that pretext induced the complainant to part with Rs.3 Lakhs. Further, the complaint discloses the fact that the Applicant had promised to repay the amount but the cheque then issued was also dishonoured. Furthermore, the applicant had agreed to deposit Rs.3 Lakhs in this Court. However, till date, he has not deposited it. Thus, in view of the facts aforesaid and taking into consideration the nature of the offence committed by the applicant, the application deserves no consideration which is rejected accordingly.
