After his arrest on March 20, 2017 in crime No.115/ 2017 for offence punishable under sections 302, 504, 506, read 34 of the Indian Penal Code and section 3 and 25 of the Arms Act registered with Valsang police station, Solapur, the applicant came to be charge-sheeted.

The allegations against the applicant are, the applicant used firearm in which Mallikarjun, due to head injuries, lost his

Statements of eye witnesses, Madhukar, Sanjay, Raju and others in categorical terms implicate the applicant in the offence. The cause of death corroborates with the role attributed to the applicant for use of firearm. The weapon is already seized in the crime in question.

Considering the seriousness of the offence which is punishable with life or death and availability of direct evidence against the present applicant, in my opinion, no case for grant of bail is made out. The application is rejected. (NITIN W. SAMBRE, J.)
