Heard the learned counsel for the applicant and the learned APP for the State.

By this application, the applicant seeks pre-arrest bail in connection with C.R. No.1103/2015 registered with the Kasarvadavli Police Station for the offence punishable under section 408 of IPC. 3.

The applicant was the CEO of M/s. Ritu Automobiles Pvt. Ltd. It is alleged that the applicant taking advantage of his position misappropriated funds to the tune of Rs.37,48,506/-. 4.

According to the Learned Counsel for the applicant, the applicant was short of funds for purchasing a residential flat and hence

rsk ABA-1109-15 he requested his employer Mr. Manoj Lalwani, owner of M/s. Ritu Automobiles Pvt. Ltd. for financial assistance and that Manoj Lalwani helped the applicant by giving him Rs.39,00,000/- by way of friendly loan. The Learned Counsel for the applicant states that the applicant has paid the complainant the entire sum. According to the FIR the total sum mentioned therein is Rs.37,48,506/-. The complainant is present in court. He does not dispute the fact that he has received the said amount. Considering the aforesaid facts, the applicant is granted anticipatory bail on the following terms and conditions:

ORDER

(i) In the event of arrest, the applicant shall be enlarged on bail on furnishing P. R. Bond in the sum of Rs.10,000/- with one or two sureties in the like amount.
