R.D. DHANUKA, J.
DATE :
11th JUNE, 2018 P.C.
By this writ petition filed under Article 227 of the Constitution of India, the petitioner has impugned the order passed by the learned Minister for not granting stay to the order passed by the respondent no.2 and 3. The revision application filed by the respondent no.4 is already placed on board for hearing and final disposal before the learned Minister. There is no ad-interim order passed by this court in this petition till date. The interest of justice would be met with if the learned Minister is directed to hear the revision application expeditiously and in accordance with law without being influenced by the observations made in the order dated 30th May, 2017. I, therefore, pass the following order :- (a) The learned Minister shall dispose of the revision application filed by the respondent no.4
kvm 2/2 32-WP9497.17 within three months from the date of the hearing proposed to be heard tomorrow.
(b) The interim order passed by the learned Minister to continue during the pendency of the revision application and for a period of two weeks from the date of communication if the same is adverse against the respondent no.4 before the learned Minister.
(c) It is made clear that this court has not expressed any views on the merits of the matter and all the contentions raised by both the parties are kept open.
(d) The parties are directed to appear before the learned Minister proposed to be held tomorrow and shall not ask for any unnecessary adjournment. 2.
Writ petition is disposed of in the aforesaid terms. No order as to costs.
3.
The parties as well as the learned Minister to act on the authenticated copy of this order.
