The applicant herein has sought to condone the delay of three months in filing the appeal against the judgment and order dated 18th January, 2016 passed by the learned Commissioner for Employees Compensation and the Judge of the First Labour Court, Nashik in APP.WC.(NF) No.163/2013.

The learned Counsel for the respondent nos.1 and 2 have stated that they have no objection for condoning the delay. The respondent no.3 is not present though duly served. In the light of the statement made by the learned Counsel for the respondent nos.1 and 2, and in view of the reasons state in para 3 and 4 of the application, which in my considered view constitute sufficient cause, the delay is condoned.

First appeal be registered subject to removal of office objections.

Learned Counsel Mr. Hitesh Shah waives service on behalf of respondent no.1 and learned Counsel Mr. A.R.S.Baxi waives service on behalf of respondent no.2.
