Adv. Kangutkar states that she received instructions to appear on behalf of the Respondent. She undertakes to file vakalatnama within four weeks from today. The undertaking is accepted.
By this Civil Application, the Applicant wife seeks condonation of 63 days delay in preferring the Family Court Appeal challenging the judgment and decree dated 08.02.2018 passed in Marriage Petition A-486/2016.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, we Basavraj G. Patil 1/2
918.227.18-cam.doc are satisfied that the Applicant has made out a case for allowing the present Civil Application.
Hence, the following order:
a) Civil Application is allowed in terms of prayer clause (a) which reads thus:
"(a) That by an order of this Hon'ble Court the delay of 63 days caused in filing the present Family Court Appeal challenging the judgment and decree dated 08.02.2018 in Marriage Petition No.A-486/2016 may kindly be condoned."
b) Civil application stands disposed off accordingly. c) Office is directed to place the Family Court Appeal as well as the pending Civil Application for admission and/or orders on 13.12.2018.
