Heard learned advocate for the petitioner. The challenge is to the order dated 29 June 2016 rejecting the application for appointment of the Court Commissioner. The application was moved when the suit was kept for argument. It is informed that the matter is kept before the Trial Court for arguments on 23 September 2016. At this stage I am not inclined to examine the challenge in this petition. In any case, the petitioner can always take up the contention under Section 105 of the Code of Civil Procedure in appellate proceeding. The Writ Petition is rejected.
