Heard learned counsel for the parties.

By this application, the applicant seeks his enlargement on bail in connection with C.R. No. 534 of 2021 registered with the Jaikheda Police Station, District - Nashik (Rural), for the alleged offences punishable under Sections 7 and 7(a) of the Prevention of Corruption Act, 1988.

Perused the papers. According to the prosecution, Jibhau Landge lodged a complaint as against the applicant and another co-accused 1/3
- Ramesh Garud alleging the aforesaid offences. It is alleged in the complaint lodged by Jibhau Landge, that on 30th August 2021, he was informed by the applicant and co-accused - Ramesh that in order to avoid any police action against him on a complaint lodged by one Priyanka Thoke, he should give Rs.40,000/- as bribe, pursuant to which, a trap was laid and the applicant and co-accused - Ramesh were arrested on the spot. It is complainant's case that the applicant was given Rs.25,000/- and coaccused - Ramesh Rs.2,000/-. Admittedly, the money was not handed over to the applicant, however, the applicant was present at the time when the money was handed over to co-accused - Ramesh and when trap was laid. The applicant is in custody since 2nd September 2021. 4.
In the facts, further detention of the applicant is not warranted. Accordingly, the application is allowed and the applicant is enlarged on bail, on the following terms and conditions:-
ORDER
(i) The applicant be released on cash bail in the sum of Rs. 20,000/- for a period of eight weeks;
(ii) The applicant shall within the said period of eight weeks, furnish P.R. Bond in the sum of Rs. 20,000/- with one or two sureties in the like amount;

(iii) The applicant shall attend the Anti-Corruption Bureau, Nashik, every Monday, between 11:00 a.m. to 1:00 p.m. till the filing of the charge-sheet;
(iv) The applicant shall inform his latest place of residence and mobile contact number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Court seized of the matter and to the Investigating Officer of the concerned Police Station;
(v) The applicant to cooperate with the conduct of the trial and attend the trial Court on all dates, unless exempted. 5.
The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the observations made herein are prima facie, and the trial Court shall decide the case on its own merits, in accordance with law, uninfluenced by the observations made in this order. 7.
