WRIT PETITION (ST.) NO.22880 OF 2022 Both petitioners, prima facie, seem to have done MBA. Petitioner no.1 appears to have done MBA in HR and Marketing and petitioner no.2 have done MBA in Finance and Marketing. Therefore, prima facie both these petitioners seem to have the requisite qualification as per the advertisement that was released by the Commissioner of Sugar, respondent no.2. However, we find in the rejection list which, we are Gauri Gaekwad

2/2 18.WP-9583-2022.doc informed by Ms. Solunke on instructions from Mr. Titakare, has been prepared by respondent no.2, in the case of petitioner no.1 it is stated "BSc and MBA (Marketing)" only and in the case of petitioner no.2 it is stated "B.Com, MSc (Electronics) and MBA (Finance and Marketing)". Petitioner no.2 has not stated anywhere that he has got MSc in Electronics and it is rather strange that someone who has done graduation in B.Com could get post graduation in MSc (Electronics). This prima facie indicates non application of mind by respondent no.2. As regards petitioner no.1, Ms. Manesh states that he has done MBA - HR and Marketing. Therefore, respondent no.2 is directed to remain present in Court to explain the basis for filing up this rejection list/statement. At the request of Ms. Solunke, stand over to 19th April 2023.
