The incident is of the year December 2013. The co-accused were arrested on 20th November 2013 and 30th December 2013. The applicant was arrested in connection with C.R. No. 78/2013 on 14th April 2014 for the alleged offences punishable under Sections 394 and 34 of the Indian Penal Code and under Sections 3 and 25 of the Arms Act. Subsequently, provisions of MCOC Act came to be applied. Learned counsel for the applicant does not press this application. He, however, requests that the trial of the applicant be 1/3

expedited, since the applicant is in custody since April 2014 i.e. for than 7 years.

The application is accordingly disposed of as not pressed. It is made clear that this application has not been heard on merits. However, having regard to the fact that the case is of the year 2013 and the applicant is in custody since April 2014, the trial of the applicant is expedited. The learned Judge to conclude the case as expeditiously as possible and in any event, within 4 months from the date of receipt of this order.

Learned A.P.P to ensure that all the accused are produced before the trial Court either physically or through video-conferencing, as may be directed by the trial Court. The prosecutor to keep the prosecution witnesses present on the dates given by the trial Court. All parties to cooperate in the expeditious disposal of the trial. Liberty is granted to the applicant to file a fresh application, in the event the trial does not conclude within the said period, for no fault of the applicant.
