The learned counsel appearing for Respondent submits that the present Petition challenges order dated 9 May 2022 declining the ad-interim relief granted by the Appellate Court during pendency of Misc. Civil Appeal No.35 of 2022. She places on record judgment and order dated 11 January 2023 passed by the District Judge-1, Vasai, Mumbai thereby dismissing Misc. Civil Appeal No.35 of 2022. She would submit that on account of judgment and order dated 11 January 2023 passed by the District Judge, the present Petition has been rendered infructuous.

Stand over to 25 January 2023.

It is made clear that if none appears on behalf of Petitioners on the next date, this Court would be constrained to pass final order in the present Petition."
