1] Applicant is seeking regular bail in C.R. No. 438/2020 registered with Oshiwara Police Station for Offences punishable under Sections 376(2)(n), 354(c), 406, 506, 509 of the Indian Penal Code.

2] Perused the statement of father of the victim recorded on 25/09/2020 and other statements of witnesses including that of statement of victim.

3] From the investigation carried out, it appears that victim 1/2

38.3328.21 BA sp.doc herself was voluntarily in physical relation with the applicant. It appears that to save her skin, she appears to have implicated the applicant in the offence alleging sexual assault and criminal breach of trust.

4] Applicant has already suffered incarceration for more than one year.

(i) Applicant be released on bail in C.R. No. 438/2020 registered with Oshiwara Police Station for Offences punishable under Sections 376(2)(n), 354(c), 406, 506 of the Indian Penal Code upon furnishing P.R. bond in the sum of Rs. 15,000/- with one or more sureties in the like amount.

(ii) Applicant shall neither influence the witnesses nor tamper with evidence in any manner.
