The learned counsel for the Applicant submits that by mistake, it remained on their part to comply with the conditional order.

He undertakes to comply with the same within 2 weeks from today. Undertaking is Accepted.

39.3333.15learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Conditional order dated 12/02/2015 is recalled to the extent of dismissal of the Civil Application No.3398/2014 with First Appeal (ST) No.17768/2014.

b) Civil Application No.3398/2014 with First Appeal (ST) No.17768/2014 is restored on file for hearing and final disposal on its own merits. c) Two weeks time from today is granted to the Applicant to comply with the order dated 12/02/2015.

d) If order dated 12/02/2015 is complied with within stipulated time as stated herein above, Office is directed to issue notice to the Respondents, as per order dated 12/02/2015.

e) Civil Application stands disposed off accordingly.
